1. Introduction
This website is owned and operated by cvseeme Limited, referred to in this document as “we” or “us”. The expression “Website” in this document means this website. We are a company registered in England No. 6517148 and our registered office is at 124 High Street, Hampton, Middlesex, TW12 1NS.
By using the Website you accept these terms and conditions. If you do not accept them, you may not use the Website. Some of the terms and conditions are specific to users of the Website who are seeking jobs (“Candidates”), and others to users who are prospective employers seeking employees (“Employers”), including recruitment agencies. These terms and conditions are governed by English law, and our use of personal information supplied by you when you use the Website is governed by our privacy policy, which is set out after these terms and conditions.
We provide the Website to assist the lawful activities of Candidates and Employers. These terms and conditions are designed to ensure that all users behave responsibly and in accordance with their legal obligations when using the Website. The Website offers the Candidate a means to upload their curriculum vitae (“CV”) and a video presentation (“Candidate Video”, referred to together with the CV as “Candidate Profile”), and offers Employers an advertising platform where they are able to upload video presentations and information about jobs (together referred to as “Employer Materials”, which together with Candidate Profiles are referred to as “User Materials”) and to search CVs that Candidates have chosen to make searchable.
The Website is therefore merely a conduit for communications between Candidates and Employers and we accept no responsibility for the content of any User Materials.
2. Your use of the Website: all users
This section applies to all users of the Website, including casual visitors as well as Candidates and Employers
We own all copyright, database rights and all other intellectual property and other rights comprised in or relating to the Website and the data it contains, but not to User Materials. You can use the Website only with our permission and we grant you a non-exclusive licence to access and use the content in the Website for your own purposes. You may not reproduce, distribute or communicate to the public any part of the content for commercial purposes.
You may not upload to the Website any material which in our opinion:
- is libellous, defamatory, invasive of privacy, obscene, pornographic or harassing;
- infringes any intellectual property rights (including copyrights) of any third party;
- is the trade secret or other confidential information of any third party;
- violates any law or regulation;
- advocates illegal activity; or
- advertises or solicits funds for goods or services.
Any material uploaded to the Website which in our absolute discretion we consider falls into any of these categories will be removed without notice to you and your use of the Website may be terminated immediately with no refund of any consideration paid by you for the use of the Website.
You may not download any material (including User Materials but excluding CVs) from the Website unless expressly permitted to do so. You may view materials on the Website only using the technical means provided on the Website itself.
You may not attempt to circumvent or violate any security measure intended to protect any material on the Website or attempt to access material on the Website, the Website itself or the servers on which the Website is hosted for any reason. You may not access the Website otherwise than by the normal use by one human being of a browser program and you may not harvest or collect data from the Website relating to any user of the Website.
The Website undergoes a constant process of development to ensure the best possible experience for all users of it. The nature and the form of the services provided through it might therefore vary from time to time and we do not promise to provide any particular features, even if they have appeared on the Website at some point. We might even have to suspend the Website or certain services on it at times, though we will do all we reasonably can to keep any downtime to a minimum.
You can stop using the Website and any of the services provided through it at any time with no need to give notice to us.
You acknowledge that you alone are responsible for any breach of your obligations under these terms and conditions and for the consequences of any such breach, including any loss or damage that we might suffer. We have no liability to you or to any third party for any such breach or consequences.
3. Your use of the Website: Candidates
This section applies to the use of the Website, and the services provided through it, by Candidates.
You are responsible for keeping secret any password or log-in information issued to you to enable you to use the Website. We are not responsible for any consequences flowing from your disclosure of your password or log-in details to any other person.
Once you have registered with the Website you may submit your Candidate Profile consisting of a CV and a video presentation in accordance with the instructions presented on the relevant page of the Website. The purpose of the exercise is to make this information available to prospective employers and security measures are in place to prevent others from gaining access to your information. We cannot guarantee that security measures will never be breached and we advise you not to post information in your Candidate Profile that might be of a sensitive or confidential nature.
You retain all rights (including copyright) in your Candidate Profile, but as a condition of using the Website you grant to us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, make available and communicate your Candidate Profile to Employers in accordance with any preferences you have communicated to us through the mechanisms provided on the Website. This licence terminates when you remove your Candidate Profile from the Website or close your account with us.
You alone are responsible for the content of your Candidate Profile, and you warrant and undertake to us that it consists of your own biographical information and that it is and will remain correct, accurate and complete.
With regard to the content of Employers’ postings on the Website, we draw your attention to section 5 below. We neither prepare nor vet material posted by Employers and accept no responsibility for the content save that if we become aware of material being posted in breach of any term of this agreement we will take steps immediately to remove such posting.
4. Your use of the Website: Employers (including recruiters)
This section applies to the use of the Website, and the services provided through it, by Employers and recruiters.
These terms and conditions take precedence over any terms and conditions that you might use in your own business.
When you register with us and open an account you enter into a contract with us and these terms and conditions form part of that contract.
You are responsible for keeping secret any password or log-in information issued to you to enable you to use the Website. We are not responsible for any consequences flowing from your disclosure of your password or log-in details to any other person.
You warrant to us that any Employer Materials uploaded by you (including employer videos and job postings) are true and accurate, do not contravene any legal requirements of any nature, and comply where appropriate with the British Code of Advertising Practice or any other applicable code of practice or similar statement of good practice. If you breach this requirement you will immediately rectify the breach and fully indemnify us against any fines, losses, costs, damages, charges, claims, demands, expenses, direct losses, loss of profit and indirect and consequential losses we suffer as a result of your breach.
We will use our best endeavours to ensure that your Employer Materials are available on-line at all times, but make no warranties or representations that the Website will be available to users without interruption.
The fees charged for Employers’ access to and use of the Website will be in accordance with our published scales from time to time. These are quoted exclusive of value added tax. In the event that you fail to pay the appropriate fee for some element of the services delivered through the Website we will not be obliged to provide that or any other service ordered by you.
5. Limitation of Liability
We exclude all warranties, express or implied, relating to the Website and to the accuracy of any material posted to it by Candidates or Employers. This includes, but is not limited to, any implied warranty that the information it contains is accurate or up-to-date or is suitable for any particular purpose. We shall not be liable for any loss or damage suffered as the result of the use of the Website.
You acknowledge that we do not control the material posted by any third party and can accept no liability for any material which is inaccurate, misleading, offensive, defamatory, obscene or otherwise incorrect.
You agree to indemnify and hold us and our employees and agents harmless from and against any claims, actions or demands including without limitation reasonable legal fees arising from your use of the website or your breach of these terms.
6. General
No representations made by us prior to the making of an agreement with you shall form part of the agreement or be of any effect whatsoever. No variation of addition to these terms and conditions shall be binding upon us unless it is in writing and signed by our authorised representative.
No waiver by us of a breach by you of the agreement between us shall operate as a waiver of any past or future breach.
If any provision or part of a provision of these terms and conditions shall be found by any court of competent jurisdiction to be invalid or unenforceable such validity or unenforceability shall not affect the other provisions or parts thereof all of which shall remain in full force and effect.
Any communication sent by us to the email address shown in your registered details will be deemed to have been delivered immediately it is sent.
It is not intended to confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
Changes to these terms and conditions of use will be posted here. These terms were last updated September 2008.
